Terms of Service.

These Terms of Service ("Terms") are a contract between you and Star Beverage LLC ("Star Bev," "we," or "us"). They cover everything you do on starbev.shop and every order you place with us — brew-thru, online pickup, and local delivery. Read them. By using the site or buying from us, you agree to them.

1. Eligibility

• You must be 21 years of age or older to buy beer, malt beverages, vapes, e-cigarettes, nicotine pouches, or any other tobacco/nicotine product from us. This is a federal and Pennsylvania state requirement and we will not bend on it.
• You must have the legal capacity to enter into a binding contract — basically, you must be a competent adult.
• Branded merchandise (apparel, drinkware, stickers, koozies) has no age restriction, but you still need to be old enough to enter into a contract for it.
• You must not be on a Pennsylvania interdiction list or otherwise prohibited from purchasing alcohol.

2. Your Account

• You're responsible for keeping your password secret and for everything that happens on your account.
• Don't share your account. One person, one account.
• Keep your information (name, phone, address) current. If your address is wrong and a delivery goes to the wrong place, that's on you.
• Tell us right away at support@starbev.shop if you think someone else got into your account.

3. Orders and Acceptance

When you submit an order on starbev.shop, you are making an offer to buy. Your order is not accepted until we send you a confirmation message (email or on-screen). We reserve the right to refuse or cancel any order, for any lawful reason, including but not limited to:

• Failure of age verification at pickup or delivery.
• Product out of stock between the time you ordered and the time we pulled it.
• Pricing or description errors on the site.
• Suspected fraud, resale activity, or reshipping to an unauthorized location.
• Delivery address outside our 5-mile radius from Altoona, PA.

If we cancel a paid order, we'll refund you in full to the original payment method.

4. Pricing and Payment

• Prices on the site are in U.S. dollars and do not include Pennsylvania sales tax, the Johnstown Flood Tax (where applicable), or other taxes and fees, which will be added at checkout.
• Prices are subject to change. We try to keep the site current, but if a price is obviously wrong, we may correct it before we accept your order.
• If we accept an order at the wrong price and we've already charged you, we'll either honor the price, refund the difference, or cancel and refund the order — your choice.

5. Brew-Thru Reservations

When you choose "Pull Up · Brew-Thru," you are reserving inventory to be paid for at the window when you arrive.

• Hold time: reservations are held for ninety (90) minutes from the requested pickup time. After 90 minutes, the items go back to the cooler.
• No-show: because brew-thru is pay-at-window, no charge is processed if you don't show. We do track no-shows; repeated no-shows may cost you the ability to reserve in the future.
• ID at the window: you must present a valid, government-issued, unexpired photo ID showing you are 21 or older. No ID, no sale.

6. Scheduled Pickup Orders

When you choose "Schedule Pickup," your payment is processed online and the order is staged for the pickup time you selected.

• Pickup window: please pick up your order within four (4) hours of the scheduled time. We'll text or email you when it's ready.
• Abandoned orders: if an order isn't picked up within twenty-four (24) hours of being staged, we will treat it as abandoned. We'll attempt to contact you. If you don't respond within seven (7) days, perishable or temperature-sensitive items may be restocked or written off, and we may charge a restocking fee for special-order items.
• ID at pickup: photo ID required if your order contains beer, vapes, or other nicotine products.

7. Local Delivery

We deliver within a five (5) mile radius of 200 Chestnut Ave, Altoona, PA 16601, subject to driver availability and weather.

• ID at the door: for any order containing beer, vapes, nicotine pouches, or other tobacco products, the recipient must present a valid government-issued photo ID showing they are 21 or older. A signature may be required.
• No ID, no delivery. If we cannot verify age, the order goes back to the store. We may restock the items and refund the order, less any applicable delivery fee.
• No delivery to intoxicated persons. Our drivers are trained and required to refuse delivery to anyone who appears visibly intoxicated. This is the law; we will not negotiate it.
• Receipt by an adult: the recipient must be 21+ at the time of delivery. We will not leave alcohol or tobacco products at the door, with a minor, or with a third party.
• Dry municipalities: we will not deliver alcohol where local ordinance prohibits it.
• Delivery fees, if any, are non-refundable once a driver has been dispatched, unless the delivery is unable to be completed because of our error.

In short: all sales of beer, tobacco, and nicotine products are final once they leave the premises, as required by Pennsylvania law. Apparel and merchandise may be returned within 14 days under the conditions in the Refunds Policy.

9. Intellectual Property

The Star Beverage name, the Star Bev wordmark and logo, the site design, code, photography, copy, and product descriptions are owned by Star Beverage LLC or our licensors and are protected by U.S. copyright and trademark law. You may not copy, distribute, reproduce, or resell any of it without our written permission.

10. Acceptable Use

You agree not to:

• Use the site for any illegal purpose or in violation of any local, state, or federal law.
• Place orders using false information, a stolen card, or someone else's identity.
• Buy our products with the intent to resell them, unless we have authorized you in writing as a wholesale customer.
• Scrape, crawl, or mass-download the site, the menu, or pricing.
• Attempt to bypass, defeat, or trick the 21+ age gate.
• Interfere with the operation of the site, including denial-of-service attacks, vulnerability probing without authorization, or sending malware.

13. Indemnification

You agree to defend, indemnify, and hold harmless Star Beverage LLC and its owners, employees, and agents from any third-party claim, loss, liability, or expense (including reasonable attorney's fees) arising out of: (a) your violation of these Terms; (b) your violation of any law or third-party right; (c) your misuse of products purchased from us, including providing alcohol or tobacco/nicotine products to anyone under 21.

14. Governing Law and Venue

These Terms and any dispute arising out of them are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Except as set out below, the exclusive venue for any dispute is the Court of Common Pleas of Blair County, Pennsylvania, or the U.S. District Court for the Western District of Pennsylvania.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal claim, you agree to contact us at support@starbev.shop with a written description of the issue. We'll try to resolve it informally within thirty (30) days.

15.2 Small Claims

Either of us can bring a claim in the Magisterial District Court of Blair County, Pennsylvania (small claims) if the claim is within that court's jurisdictional limit. Small claims actions are not subject to the arbitration clause below.

15.3 Binding Arbitration

For any other dispute, you and Star Beverage agree to resolve it through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Blair County, Pennsylvania (or by video, by agreement). The arbitrator's decision is final and may be entered as a judgment in court.

15.4 No Class Actions

Disputes will be resolved on an individual basis. You and Star Beverage waive the right to participate in a class action, class arbitration, or representative action.

15.5 Opt-Out

You may opt out of the arbitration and class-action waiver in sections 15.3 and 15.4 by sending written notice to Star Beverage LLC, Attn: Arbitration Opt-Out, 200 Chestnut Ave, Altoona, PA 16601 within thirty (30) days of first accepting these Terms. Your notice must include your name, the email on your account, and the statement "I opt out of arbitration." Opting out does not affect any other part of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date at the top of this page and, for significant changes, send a notice to the email on your account at least 14 days before they take effect. Continued use of the site after the effective date means you accept the updated Terms.

17. Severability and Waiver

If any part of these Terms is held to be unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of that right.

18. Entire Agreement

These Terms, together with the Privacy Policy, the Refunds Policy, and the Compliance & 21+ Statement, are the entire agreement between you and Star Beverage about the site and your orders.
